Terms of service

The agreement for using Plainbooks: the plan and billing through the App Store, what happens when a plan ends, acceptable use, the limits of suggestions and reports, and how disputes are resolved.

Updated

About these terms

These terms are an agreement between you and Enki Studios, LLC, a Delaware limited liability company (“Enki Studios”, “we” or “us”), for your use of Plainbooks. “You” means the person who signs in to Plainbooks, and the business or businesses whose books you keep in it.

By signing in to or using Plainbooks, you agree to these terms and to our Privacy policy. If you’re accepting for a business, you confirm that you have the authority to bind it.

Please read Disputes and arbitration. Unless you opt out, disputes are resolved by binding individual arbitration, not in court, and you give up the right to a jury trial and to take part in a class action.

The service

Plainbooks is an app for iPhone and iPad that keeps the books of one or more small businesses. You photograph or upload receipts, import statements and payout reports; the app reads them, suggests how to file them, and keeps everything organized by business and by year. It adds up reports from what you filed, shows them in its widgets, and exports a folder for your accountant. A personal book comes along as a convenience. Our pricing page lists what the plan includes.

While your account has an active trial or plan, you may use Plainbooks for your own businesses. We own Plainbooks, this website and their content. These terms don’t transfer any ownership to you.

Who can use Plainbooks

  • You must be at least 18, or the age of majority where you live, and able to enter into a binding contract.
  • You use Plainbooks for your own books, or those of a business you’re authorized to keep books for.
  • You sign in with your own Apple Account or Google Account, and you’re responsible for keeping your device and that account secure.

Plan, free trial and billing

  • One plan. Plainbooks costs $9.99 a month or $79.99 a year, in US dollars. Everything is included: up to 10 books, 20 GB of storage, and every feature; the pricing page lists it.
  • Free trial. The yearly plan starts with a 14-day free trial. The monthly plan has no trial and starts at once. Apple gives the trial once per Apple Account.
  • Seven days to start. A new account has 7 days to start the free trial or a plan. An account that hasn’t is deleted, with everything in it.
  • Billing through the App Store. Apple bills you, and the subscription appears in your Apple Account. Apple’s terms apply to trials, charges, renewals and refunds. You manage or cancel the subscription in your Apple Account’s Subscriptions settings.
  • When a plan ends. Your account becomes read-only: you can view, search and export, and adding is paused. It stays that way for 30 days after a trial that wasn’t continued and 6 months after a paid subscription ends. Then the account and all its data are deleted, after the warnings described in our Privacy policy. Subscribing again before then keeps everything.
  • Price changes. We may change our prices. Apple will tell you before a new price applies to you, and you can cancel before it does.

Cancelling

You can cancel at any time in your Apple Account’s Subscriptions settings. The plan runs to the end of the period you paid for, then your account becomes read-only as described above.

To delete your account and everything in it, use Settings › Delete account in the app. Export anything you want to keep first. Deleting the account doesn’t cancel the subscription; cancel it with Apple.

Acceptable use

You agree not to:

  • use Plainbooks for anything unlawful, or to keep records that misrepresent a business;
  • upload files that aren’t receipts, statements, payout reports or business documents, or use Plainbooks as general file storage;
  • try to access another account, or get around plan limits or our security measures;
  • disrupt or overload Plainbooks, or test it for vulnerabilities without our written permission;
  • copy, resell or reverse engineer Plainbooks, except where the law allows it.

We may suspend uploads or access if your use puts Plainbooks or other users at risk.

Suggestions and reports are not advice

Plainbooks helps you keep your books. It doesn’t decide for you, and it isn’t tax, legal or accounting advice.

  • Reading can be wrong. The shop, date and total read from a receipt, by the phone or by the AI model, are suggestions. You check and save every receipt. Anything marked “read by AI, please check” especially.
  • Filing can be wrong. The suggested business, category and Schedule C line are suggestions. The built-in categories follow the IRS form, and you can set the deductible share of your own categories, but whether an expense is deductible, and how much, is for you and your accountant to decide.
  • Imports can need checking. Statements and payout reports are read by fixed rules; a file in an unexpected format can import differently than you expect. Review the preview and the rows that wait in To review.
  • Reports add up what you filed. The profit and loss, the tax view, the set-aside estimate, the widgets and every other number are arithmetic on your own entries. They’re only as complete as your books. The set-aside estimate uses a rate you choose and isn’t a tax calculation.
  • Reminders can be missed. Tax due-date reminders are local notifications on your device. They depend on your device’s settings and aren’t a substitute for knowing your deadlines.
  • You decide. You’re responsible for what you file, what you deduct and what you pay.

Availability and changes to the service

  • We work to keep Plainbooks running, but we don’t promise that it will always be available or free of errors.
  • Plainbooks depends on Apple, Google and Cloudflare. If they have problems or change their services, Plainbooks may stop working, fully or in part. We aren’t responsible for their services.
  • We may change, add or remove features. If we remove a major feature or stop offering Plainbooks, we’ll give you at least 30 days’ notice and time to export.
  • We may pause Plainbooks briefly for maintenance or to protect its security.

Your data

  • You keep ownership of your books, receipts and documents. You allow us to store and process them only to provide and support Plainbooks, as described in our Privacy policy.
  • You can export everything at any time, and delete it at any time.
  • You’re responsible for having the right to keep the records you upload.
  • We don’t sell your data, use it for advertising, or use it to train AI models.

Disclaimers

Plainbooks is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t warrant that readings, suggestions, imports, reports, reminders or exports will be accurate, complete, on time or free of errors.

Limitation of liability

To the fullest extent the law allows:

  • We aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if we were told they were possible.
  • We aren’t liable for taxes, penalties, interest, missed deductions or other costs that result from relying on readings, suggestions, reports or reminders, or from records you didn’t keep.
  • Our total liability for all claims relating to Plainbooks or these terms is limited to the fees you paid for Plainbooks in the 12 months before the event that led to the claim.

Some places don’t allow these limits. Where that’s the case, they apply only as far as the law allows.

Indemnity

You agree to defend, indemnify and hold harmless Enki Studios and its members, employees and contractors from any claims, damages, losses and costs, including reasonable legal fees, that arise from:

  • your use of Plainbooks in breach of these terms;
  • the receipts, documents and other content you add, including content you don’t have the right to share;
  • your breaking any law or anyone else’s rights.

Termination

  • You can stop using Plainbooks at any time by cancelling your subscription or deleting your account.
  • We may suspend or end your access if you break these terms, or if the law requires it. Where it’s reasonable, we’ll tell you first and give you time to export.
  • When your account is deleted, your data is deleted as described in our Privacy policy.
  • Parts of these terms that by their nature should continue after your use ends, including the disclaimers, limitation of liability, indemnity, disputes and arbitration, the time limit for claims and governing law, continue to apply.

Changes to these terms

We may update these terms. When we do, we’ll change the date at the top of this page. For significant changes, we’ll post them on this page at least 30 days before they take effect. If you keep using Plainbooks after a change takes effect, you accept the updated terms. If you don’t agree, you can cancel and delete your account.

Disputes and arbitration

This section affects your rights. It applies to any dispute, claim or controversy between you and Enki Studios that relates to Plainbooks or these terms (“a dispute”).

  • Talk to us first. Before starting a case, email support@madebyenki.com with your name, the email of your Plainbooks account, what the dispute is about and what you want. We’ll do the same if we have a dispute with you. Both sides then have 60 days to try to settle it informally.
  • Binding individual arbitration. If it isn’t settled, the dispute will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. The arbitration can take place by video, by phone or on written submissions alone; if a hearing in person is needed, it will be held in the county where you live or in Delaware, as you choose. Fees are paid as the AAA’s consumer rules provide. The Federal Arbitration Act governs this section. The arbitrator decides every question about the dispute, including whether it must be arbitrated, except as this section says otherwise.
  • Exceptions. Either side may bring an individual claim in small-claims court if it qualifies. Either side may ask a court for an order to stop the misuse of its intellectual property, or unauthorized access to Plainbooks or an account.
  • No class actions. You and we may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator can’t combine more than one person’s claims and can award relief only to the person bringing the claim.
  • No jury trial. If a dispute goes to court for any reason, you and we both give up the right to a trial by jury.
  • Opting out. You can opt out of arbitration within 30 days of first agreeing to these terms, by emailing support@madebyenki.com with the subject “Arbitration opt-out” and the email of your Plainbooks account. Opting out doesn’t change any other part of these terms.
  • If part of this section fails. If the no-class-actions rule is found unenforceable for a claim, that claim goes to court, not arbitration. If any other part of this section is found unenforceable, the rest still applies.
  • Changes. If we change this section, the change doesn’t apply to a dispute you told us about before the change.

Time limit for claims

Any claim relating to Plainbooks or these terms must be brought within one year after it arose, unless the law requires a longer period. After that, the claim is permanently barred.

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs Disputes and arbitration. Any dispute that isn’t arbitrated will be decided by the state or federal courts located in Delaware, and you and we agree to those courts’ jurisdiction.

Apple

Plainbooks is distributed through Apple’s App Store, so these points also apply:

  • These terms are between you and Enki Studios, not Apple. Enki Studios, not Apple, is responsible for Plainbooks and its content.
  • Apple has no obligation to provide maintenance or support for Plainbooks.
  • If Plainbooks fails to meet any warranty that applies, you may tell Apple, and Apple will refund the price you paid for it, if any. To the fullest extent the law allows, Apple has no other warranty obligation for Plainbooks.
  • Apple isn’t responsible for any claims about Plainbooks, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If anyone claims that Plainbooks infringes their intellectual property, Enki Studios, not Apple, is responsible for investigating, defending, settling and discharging the claim.
  • You confirm that you aren’t located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you aren’t on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce them against you.
